1. Scope
1.1 These General Terms and Conditions (“GTC”) apply to all offers, services, courses, exams, consultations, private lessons, corporate courses, online courses, and other services provided by ILS and ILS Nachhilfe.
1.2 These Terms and Conditions form an integral part of all contracts between ILS / ILS Nachhilfe and its clients.
1.3 Any terms and conditions of the client that differ from these shall apply only if they have been expressly acknowledged in writing by ILS / ILS Nachhilfe.
2. Conclusion of the Contract and Acceptance of the Terms and Conditions
2.1 A contract is formed as soon as a registration, booking, appointment, or course confirmation is made in writing, electronically, verbally, or by implication and is confirmed by ILS / ILS Nachhilfe.
2.2 Written or electronic confirmation includes, in particular, confirmations via email, text message, WhatsApp, contact form, online booking, on-site signature, social media message, payment of an invoice or down payment, and attendance at class.
2.3 Any written or electronic confirmation of a course, lesson, exam, or other service shall be deemed a binding contract for the sale of goods or the provision of services within the meaning of Art. 1 et seq. of the Swiss Code of Obligations (OR).
2.4 By making their first registration, booking, or confirmation, the customer declares that they have read, understood, and accepted the currently valid Terms and Conditions.
2.5 Once given, consent to these Terms and Conditions is valid indefinitely and applies to all future bookings, registrations, scheduling of appointments, course extensions, follow-up courses, exams, and services provided by ILS / ILS Nachhilfe.
2.6 Consent does not need to be given again for subsequent bookings. If another registration or course confirmation is submitted—particularly via email—the Terms and Conditions are automatically deemed to have been accepted again.
2.7 ILS / ILS Tutoring reserves the right to amend these Terms and Conditions at any time. For new bookings, the Terms and Conditions in effect at the time of booking shall apply.
3. Prices and Payment Terms
3.1 The prices published from time to time or agreed upon individually shall apply.
3.2 Unless otherwise agreed, invoices are payable net within 10 days.
3.3 If the customer defaults on payment, the customer shall be deemed to be in default without further notice.
3.4 If the customer is in default of payment, ILS / ILS Nachhilfe is entitled to charge late payment interest of 5% per year in accordance with Art. 104 of the Swiss Code of Obligations. In addition, the following reminder fees may be charged:
- Payment Reminder: Free of Charge
- Reminder: CHF 30.–
- Final reminder: CHF 60.– (total CHF 90.–)
If the final reminder is unsuccessful, the claim may be referred to a debt collection or legal services firm.
3.5 All collection and legal costs shall be borne by the customer, to the extent permitted by law.
3.6 Payments are first applied to secondary claims and then to the principal claim.
3.7 Advance payment may be required for international customers.
4. Private Lessons and Corporate Courses
4.1 Deadlines are binding.
4.2 Cancellations must be made 24 hours in advance.
4.3 Late cancellations will be charged in full.
4.4 Exceptions apply only in the event of illness (with a doctor's note) or death (with proof).
4.5 Alternative dates or credit notes are at the discretion of ILS / ILS Tutoring.
5. Group Classes
5.1 No refunds for absences.
5.2 Goodwill credits may be issued.
5.3 Credit notes are valid for 12 months.
6. Withdrawal, Cancellation, and Course Termination
6.1 Free cancellation up to 7 days before the course begins.
6.2 Full payment is due thereafter.
6.3 No Refunds.
6.4 No cancellations for private lessons.
6.5 No right to a refund if the course is discontinued.
6.6 Credit balances expire after 3 years.
7. Teachers and Organization
7.1 Teachers may be replaced at any time.
7.2 No right to a specific teacher.
7.3 Course adjustments are permitted.
8. Online Classes
8.1 The same rules apply as for in-person classes.
8.2 Customers are responsible for any technical problems they encounter.
8.3 No Liability for Third-Party Platforms.
9. Exams
9.1 The rules of the examination organization also apply.
9.2 Registration is binding.
9.3 Fees remain due.
9.4 This applies in particular to:
- Failure
- Failure to appear
- Delay
- missing documents
9.5 Disqualification does not result in a refund.
9.6 No Review or Refund.
9.7 No Liability for Examination Decisions.
10. Trial Lesson
10.1 A maximum of two trial lessons.
10.2 A fee applies if a reservation is made immediately afterward.
10.3 No entitlement to additional trial lessons.
10.4 CHF 80.– for unexcused absence.
11. SVEB Certificate Courses
11.1–11.7 Attendance requirements, retake requirements, and examination rules as specified in the course guidelines apply.
